Legal Requirements in Illinois

Illinois has enacted the Safe Gun Storage Act, effective January 1, 2026. Under this law:

  • Firearm owners must secure firearms in a locked container or with a device that makes the firearm inaccessible to anyone other than the owner or authorized users whenever minors, at-risk individuals, or prohibited persons could gain access.

  • Simply keeping a firearm out of sight does not comply if access is likely.

  • The law applies to all locations where firearms are stored, including homes and vehicles, unless the firearm is on your person or under your immediate control.

  • Civil penalties for violations range from $500 up to $10,000 depending on the circumstances.

  • Lost or stolen firearms must be reported within 48 hours of discovery.

These requirements make practical safe storage legally mandatory in many everyday situations.

Legal Landscape in Wisconsin

Wisconsin does not have a universal safe storage mandate. However, the state enforces child access prevention laws:

  • If a loaded firearm is recklessly left within reach of a child under age 14 and the child gains access, the firearm owner can face criminal liability.

  • To avoid liability, firearms should be stored in a securely locked container, with a trigger lock, or rendered inoperable.

  • While there is no requirement to lock every firearm at all times, responsible storage is strongly recommended to prevent unauthorized access.

Even without a universal law, safe storage remains a critical practice for preventing accidents and legal complications.
